Liability Waiver

Note for the site owner: This page is a plain-English summary of the waiver only. The actual legally binding waiver that customers sign at delivery (in person on a tablet, or digitally via Smartwaiver before arrival) must be drafted or reviewed by a licensed Florida attorney familiar with recreational liability and Florida General Statutes. What is the waiver?

Before getting on the water with us, every adult paddler signs a short legal release. A parent or legal guardian signs on behalf of any minor under 18. We use a digital waiver service (Smartwaiver) so most customers sign in advance from their phone. You can also sign in person at delivery on a tablet.

What does the waiver cover?

The waiver does three things:

Required safety items

By Florida law and U.S. Coast Guard regulation, every paddleboard rental includes:

Children under 6 are required by Florida law to wear the PFD at all times on the water. Adults are required to have one onboard the paddleboard, and we strongly recommend wearing it.

Substance use

Paddling under the influence of alcohol, cannabis, or any impairing substance is prohibited and is grounds for immediate cancellation without refund. Florida BUI (Boating Under the Influence) statutes apply to paddleboards used outside designated swimming/surfing areas.

Photo and likeness release (optional)

The waiver includes an optional clause permitting us to use photos taken during your rental on our website and social media. You can decline this clause without affecting your rental.

Sign in advance

To save time on the beach, we'll send you a Smartwaiver link by SMS as soon as you book. Click it, sign on your phone, and you're set. If you don't sign in advance, our delivery team brings a tablet and walks you through it.
